The FDA vs. Direct-to-Consumer Genetics
The regulatory framework governing spit kits is a patchwork of compromises. To understand why your health report says what it says, you have to understand the letters the FDA sent in 2013.
In November 2013, the FDA sent a scathing warning letter to 23andMe. The core of the FDA's argument was simple: 23andMe was marketing a medical device (a test intended to diagnose, mitigate, treat, or prevent disease) without regulatory clearance.
"Consumers may rely on such reports to manage their health (e.g., to select or change dosing of a medication), and a false result could have severe consequences." — FDA Warning Letter, 2013
The Difference Between Analytical and Clinical Validity
To get back on the market, companies had to prove two things:
- Analytical Validity: Does the test accurately detect the specific genetic variant it claims to detect? (If you run the sample 100 times, do you get the same result 99 times?)
- Clinical Validity: Does the presence of that genetic variant actually correlate with the disease or trait in the real world?
For conditions like Celiac disease or late-onset Alzheimer's (APOE-e4), the clinical correlation is well established. But for complex diseases like diabetes or heart disease, which are polygenic (influenced by thousands of genes) and heavily tied to lifestyle, proving clinical validity is nearly impossible for a single consumer test.
The "Authorized" Workaround
Today, 23andMe is the only major DTC company with FDA authorizations for specific tests. However, these are classified as Over-The-Counter (OTC) Carrier Screening Tests or Genetic Health Risks (GHR).
The FDA explicitly mandates that these reports include extensive disclaimers stating they are not intended for diagnosis and do not describe a person's overall risk of developing a disease.
